15. These Terms between You and Trex shall be governed by the laws of the Commonwealth of Virginia without regard to its conflict of law provisions. You and Trex agree to submit to the sole and exclusive personal jurisdiction of the federal and state courts located within the Commonwealth of Virginia for any dispute arising from, or related to, these Terms. The failure of Trex to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16. These Terms constitute the entire agreement governing the use of the Trex Web site, superceding any prior versions of the Terms. If any provision of these Terms or any incorporated documents are found by a court of competent jurisdiction to be invalid, You and Trex nevertheless agree that the court should endeavor to give effect to Trex's intention as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
